Please Note: The terms & conditions detailed in this document apply to all the ONEWEEKMODEL.COM
members.
These terms & conditions, also know as the membership agreement, along with the
privacy policy and SPAM policies, are a binding legal agreement between you as a
member of ONEWEEKMODEL.COM.
Agreement Terminology
Material, Materials - Refer to Photos, Visual, Resourced Content and General Content.
Service, The Service - The Features, Functions, Information and Support Services
and any other Services provided by the ONEWEEKMODEL.COM web site.
Member Materials
1. Ownership Rights - You agree that all photos that you upload as a member of ONEWEEKMODEL.COM
are your property and that you either own the copyright to the material or you have
express written permission from the owner of the copyrighted materials. You retain
all copyright and ownership rights to your uploaded materials.
2. Members Grants ONEWEEKMODEL.COM non-exclusive rights to materials - You grant
ONEWEEKMODEL.COM non-exclusive rights to use uploaded photos throughout the site
free from all fees & royalties. This includes but is not limited to the uploaded
photos and any other material provided by you to ONEWEEKMODEL.COM. At any time you
may cease to grant ONEWEEKMODEL.COM rights to any of your uploaded material by deleting
your material using the deletion function in the members area. ONEWEEKMODEL.COM
will remove any deleted material from the server instantly.
3. Copyright/Ownership Disputes - In the case of copyright or ownership disputes
ONEWEEKMODEL.COM suggests that disputing parties resolve issues directly. If ONEWEEKMODEL.COM
finds that a member has violated or infringed copyright law the materials in violation
will be removed from the server instantly. ONEWEEKMODEL.COM reserves the right to
terminate a members account in violation of copyright laws.
4. Review & Right to Remove - ONEWEEKMODEL.COM reserves the rigth to remove or reject
any photos you may provide.
5. License of Your Photos - Photos uploaded on ONEWEEKMODEL.COM is licensed under
full copyright.
General Terms
1. Provision and Maintenance of Account - ONEWEEKMODEL.COM account setup is electronic.
It is the responsibility of members to maintain the correct and most up to date
account information. It is your responsibility to adhere to all copyright laws as
well as checking for errors, violations & any unlawful obscenity.
2. Account Login and Passwords - Upon becoming a member of ONEWEEKMODEL.COM you
need to choose a unique login name and password which allows access to the web site.
Each member must keep their password strictly confidential. Remember your password!
For security reasons, ONEWEEKMODEL.COM will not release passwords for any reason,
except as may be specifically required by law or court order. In case where you
have forgot your password it is possible to retrieve a new by using the "Forgot
Your Password?" service.
3. Member Age - Member hereby swears and affirms under oath, warrants and represents
that he/she is at least fifteen (15) years of age and has the legal capacity to
enter into agreements of this nature. ONEWEEKMODEL.COM makes no representation or
warranty that the content published on ONEWEEKMODEL.COM complies with the local
laws of your jurisdiction. You are solely responsible for knowing and understanding
your local laws concerning standards of content legality. Should you be unable to
affirmatively make the representations and warranties contained herein, do NOT become
a member of ONEWEEKMODEL.COM.
4. Illegal Use of Services Provided - Ilegal and/or unauthorized usage of this site
will be investigated, and appropiate legal action taken. Members agree not to submit,
publish, or display any defamatory, inaccurate, abusive, threatening, racially offensive,
or illegal material. Members are responsible for information they send, or display
even if a claim should arise after termination of an account.
5. If you experience a problem with the ONEWEEKMODEL.COM service, please let us
know first by contacting our support.
6. Termination of Account - You may terminate your ONEWEEKMODEL.COM account at any
time, thus revoking all rights granted to ONEWEEKMODEL.COM. ONEWEEKMODEL.COM reserves
the right to terminate your account without notice if you are found to be in violation
of any of the terms & conditions detailed in this agreement.
7. Liability - Under no circumstances, including, but not limited to, negligence,
shall ONEWEEKMODEL.COM or any of its related, affiliated companies be liable for
any direct, indirect, incidental, special, consequential or punitive damages that
result from the use of, or the inability to use the Service. Member specifically
acknowledges and agrees that ONEWEEKMODEL.COM is not liable for any defamatory,
offensive or illegal conduct of any user, or for any failure of performance, error,
omission, interruption, deletion, defect, delay in operation or transmission, communications
line failure, theft or destruction or unauthorized access to, alteration of or use
of records, whether under contract or tort theory, or under any other cause of action.
8. Warranties - ONEWEEKMODEL.COM MAKES NO WARRANTIES OR REPRESENTATIONS AS TO THE
INFORMATION, SERVICES OR PRODUCTS PROVIDED THROUGH OR IN CONNECTION WITH THE SERVICE.
MEMBERS'S USE OF THE SERVICE IS AT HIS/HER OWN RISK. ONEWEEKMODEL.COM, NOR ANY PARTY
INVOLVED IN CREATING, PRODUCING, OR DELIVERING THE SERVER OR CONTENT, IS LIABLE
FOR ANY DIRECT INCIDENTAL, CONSEQUENTIAL, INDIRECT, OR PUNITIVE DAMAGES ARISING
FROM YOUR ACCESS TO, USE OF, OR INTERPRETATION OF, THE SERVICE OR PRODUCTS OR SERVICES
OR INFORMATION PROVIDED BY OR THROUGH THE SERVICE. WITHOUT LIMITING THE FOREGOING,
ONEWEEKMODEL.COM MAKES NO WARRANTY OF MERCHANTABILITY, FITNESS FOR ANY PURPOSE,
OR NON-RESULTS OF THE USE OF THE CONTENT IN TERMS OF THEIR CORRECTNESS, ACCURACY,
TIMELINESS, RELIABILITY OR OTHERWISE.
9. Local Law - PLEASE NOTE THAT SOME JURISDICTIONS MAY NOT ALLOW THE EXCLUSION OF
IMPLIED WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. CHECK
YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THE EXCLUSION OF IMPLIED
WARRANTIES. Member agrees to indemnify and hold harmless ONEWEEKMODEL.COM, its officers,
directors, managers, members, agents and employees against any claims, losses, liabilities
or expenses (including reasonable attorneys' fees) arising out of member's breach
of any term, condition or promise contained herein.
10. General Copyright - Except for public domain material and electronic messages,
all material displayed on ONEWEEKMODEL.COM is copyrighted by ONEWEEKMODEL.COM, or
is licensed under copyright by ONEWEEKMODEL.COM, and may not be copied, redistributed,
or downloaded, in whole or in part, without the prior written consent of ONEWEEKMODEL.COM
and the owner of the copyrighted or licensed to ONEWEEKMODEL.COM material. All member
uploaded material displayed on ONEWEEKMODEL.COM is licensed under member material
licensing as indicated above in the Member Section of this agreement.
11. Changes in Terms & Conditions - ONEWEEKMODEL.COM reseverves the right to make
changes to these membership terms & conditions at any time without prior notice
or warning.
Privacy Policy
1. ONEWEEKMODEL.COM acquires, stores and transmits member communications and information
that members may regard as private or sensitive.
2. ONEWEEKMODEL.COM may also use member information to provide its members with
system information or information about upgrades or updates.
3. ONEWEEKMODEL.COM will only ever send you direct mailing when there is information
on new upgrades, updates, security issues and relevant information for your account.
4. ONEWEEKMODEL.COM may provide links to its partners and other Internet sites.
These sites have separate data and privacy practices independent of ONEWEEKMODEL.COM,
and ONEWEEKMODEL.COM disclaims any responsibility or liability for their policies
or actions.
UCE / SPAM Policy
The abuse and misuse of e-mail is a serious problem. ONEWEEKMODEL.COM will not tolerate
it.
1. Definition of UCE (Unsolicited Commercial E-mail), or SPAM - The bulk UCE, promotional
material, or other forms of solicitation sent via e-mail that advertise any IP address
belonging to ONEWEEKMODEL.COM or any URL (domain) or Mailing List that is hosted
by ONEWEEKMODEL.COM.
Unsolicited postings to newsgroups advertising any IP or URL hosted by ONEWEEKMODEL.COM.
Advertising, transmitting, or otherwise making available any software, program,
product, or service that is designed to facilitate a means to SPAM.
Forging or misrepresenting message headers, whether in whole or in part, to mask
the true origin of the message.

2. Repercussions of SPAM - Across the Web, it is generally accepted that SPAM is
an inconsiderate and improper business practice.SPAM is not only harmful because
of its negative impact on consumer attitudes toward ONEWEEKMODEL.COM, but also because
it can overload ONEWEEKMODEL.COM’s network and resources.
3. Punishment For SPAM - ONEWEEKMODEL.COM reserves the right to terminate, without
warning, any account that violates this policy. Usage of ONEWEEKMODEL.COM services
constitutes acceptance and understanding of this policy. ONEWEEKMODEL.COM reserves
the right to decide what it considers "SPAM", "UCE", "mail bombing", or "bulk e-mail",
and to determine from all of the evidence whether or not the e-mail recipients were
from an "opt-in" e-mail list
